Apple didn't patent white/black under clear plastic with chrome backing and gray touch pads; they have *established that look as characteristic of iPods for years*. A company emulating the thin brick with the same elements of style shows a total lack of originality; all they did was the bare minimum to keep from getting sued: they didn't make the touch pad round. They even used the same shade of grey for the touchpads on the black and white! They could have at least done what other companies have done; change the form factor significantly and make the item ergonomic or other colored. Instead, they took all their styling cues from something Apple has been doing for years. Not to mention that, they even ripped the desktop background from the MacOS. How unoriginal can they get?
As for the Nintendo DS, isn't even a digital music player, and has a dramatically different form factor. It has no grey touchpad, and it doesn't even have chrome backing. What kind of desperate comparison is that?
